General Terms and Conditions of Sale
Any reservation at Villa Tiki Vieuxboucau Surflodge implies knowledge and acceptance of the General Terms and Conditions of Sale below:
ARTICLE 1: Booking Conditions
La réservation se fait par le site internet www.vieuxboucau-surflodge.com par carte bancaire. La totalité du paiement se fait à la réservation.
Exceptionally, Villa Tiki reserves the right to accept reservations by bank check (only for French customers or those with a French bank checking account). The customer has 5 days from the date of the reservation request to send the check, made payable to Ivan REY, to the following address: Vieuxboucau Surflodge, 5 avenue des dunes, 40480 Vieux Boucau, France. Upon receipt of the deposit, you will receive a confirmation email.
Villa Tiki cannot accommodate unaccompanied minors or pets.
Requests for groups of more than 6 people will be considered on a case-by-case basis. Please submit your request by email.
ARTICLE 2: Conditions for cancellation or modification by the customer
Toute annulation au plus tard 14 jours avant la date de début de séjour donnera lieu à un remboursement intégral excepté les frais de réservation. Dans un délai inférieur, 50% du montant total sera conservé. Toute annulation ayant lieu le jour du début de séjour ne donnera lieu à aucun remboursement.
In case of a shortened stay, the full amount of the stay will be due (except in cases of force majeure*).
ARTICLE 3: Stay at Villa Tiki Vieuxboucau Surflodge
– L’arrivée à lieu entre 15h et 20h le jour où commence votre réservation. Pour une arrivée après 20h, un supplément de 10€ est demandé.
-Le départ se fait avant 11h.
– Entretien : le ménage des espaces communs est fait chaque jour et le ménage des chambres en cours de séjour peut-être fait sur demande.
Le linge de lit est changé à la fin du séjour ou sur demande.
– Internet: Villa Tiki Vieuxboucau Surflodge provides its guests with free Wi-Fi internet access. Users are prohibited from using the service for purposes contrary to applicable regulations. In particular, it is forbidden to use the internet connection for:
– attempt to access other machines connected to the network,
– to make illegal and immoral downloads,
– watching online videos (streaming) legally or illegally,
– sending out mass emails (spamming),
– attempt to gain unauthorized access to a computer.
By accepting these terms and conditions, the Customer certifies that their computer (if it runs on a Microsoft operating system) is free of viruses and protected by up-to-date antivirus software. The Customer is responsible for their computer. Villa Tiki cannot be held liable for any loss, theft, or damage.
– Règlement intérieur : La Villa Tiki Vieuxboucau Surflodge étant un endroit calme, le bruit y est interdit après 22h00. Pour cette raison, l’éclairage extérieur s’éteint automatiquement à 23h. Les retours nocturnes doivent se faire dans le calme afin de ne pas déranger les Clients qui dorment.
By accepting the general terms and conditions of sale, the Client agrees to respect the peaceful nature of the place and to preserve the peace and quiet of other people.
The grounds of Villa Tiki Vieuxboucau Surflodge are reserved exclusively for guests. Any unauthorized person must request permission from management before entering.
La direction se réserve le droit de mettre un terme immédiat au séjour d’un client dont le comportement perturberait le bon séjour des autres clients.
Il est interdit de fumer à l’intérieur des bâtiments ainsi que sur la terrasse commune de la Villa Tiki. Un espace extérieur avec des cendriers a été aménagé, merci de l’utiliser pour respecter le droit des non-fumeurs à respirer un air pur.
ARTICLE 4: Responsibility
Intentional damage to furniture will be billed at the replacement value.
La Villa Tiki Vieuxboucau Surflodge décline toute responsabilité en cas de vol, perte ou dommage de vos effets personnels. Des casiers avec cadenas sont mis à disposition des clients du dortoir afin de pouvoir mettre en sécurité les effets de valeur.
On the other hand, customers must be covered by liability insurance.
ARTICLE 5: Force Majeure
Villa Tiki Vieuxboucau Surflodge cannot be held liable to the client for any failure to perform its obligations due to force majeure. Force majeure or fortuitous events are defined as those typically recognized by French courts and tribunals.
ARTICLE 6: Computer Data
In accordance with Article 27 of Law No. 78-17 of 6 January 1978, relating to information technology, you have the right to access and rectify data concerning you, by sending us a letter or an email.
On the other hand, Villa Tiki Vieuxboucau Surflodge undertakes not to disclose to any third party the information that you have entrusted to it.
ARTICLE 6:

General terms and conditions for equipment rental
ARTICLE 1
Contract Definition: These General Terms and Conditions of Rental (hereinafter "GTC") define the terms and conditions for booking and renting the various equipment and services on the website. All bookings and rentals are subject to compliance with these GTC. Confirmation of a booking by the customer on the website implies their full and complete acceptance of these GTC. These GTC are subject to change at the sole discretion of the Company. The conditions applicable to a booking and rental are those in effect on the website www.vieuxboucau-surflodge.com at the time of the corresponding booking.
ARTICLE 2
Matériels et prestations de services. Les différents matériels et services proposés à la réservation sur le site internet sont décrits selon des catégories et types de classification. Les visuels (photos) et éléments graphiques sont présentés à titre d’exemple mais n’ont pas de valeur contractuelle. La société Villa Tiki s’engage à fournir un matériel de qualité dans un bon état de fonctionnement. La société Villa Tiki offre la possibilité de réserver un matériel spécifique au sein d’une large gamme, mais en cas d’indisponibilité du matériel réservé le jour du début de la location, la Villa Tiki peut proposer un matériel de gamme et de technique équivalents à la catégorie réservée. Les différents équipements sont disponibles, sous réserve de confirmation par la Société. Cette confirmation est effectuée par un e-mail à l’adresse fournie par le client.
ARTICLE 3
Booking Procedure. 3.1 - The customer makes their booking as follows on the website: www.vieuxboucau-surflodge.com. The customer chooses their equipment and any accessories. The customer chooses a rental period by selecting their first and last rental days. The customer provides their personal information and delivery address to book online. The customer selects their payment method (credit card, PayPal) and reviews the General Rental Conditions. The customer pays the total rental amount including VAT after accepting the General Rental Conditions. 3.2 - Choosing electronic payment by credit card. Only upon receipt by Paygreen, which handles credit card payments, makes the booking effective. Upon receipt of Paygreen's approval, a confirmation email is sent to the customer, confirming the details of the reserved equipment, the rental period, and the price. In the event of a declined credit card or PayPal payment, the customer will be notified directly on the website. The Company reserves the right to cancel the previously registered reservation outright.
ARTICLE 4
Rental rates. The rental price is determined based on the category of equipment and accessories reserved, the service booked, and the rental period chosen, according to the rates in effect for the selected period on the date of booking. The price is inclusive of all taxes (VAT) and expressed in euros. Public rates, discounts, and reductions are listed on the website.
ARTICLE 5
Equipment collection takes place at the Villa Tiki address: 5 avenue des dunes, 40480 Vieux Boucau. An appointment will be arranged in advance by phone or email. It is the customer's responsibility to notify Villa Tiki of any changes to the appointment date or time. The date, time, and location for returning the surf equipment will be discussed with the customer upon delivery.
ARTICLE 6
E-caution Lors du retrait du matériel une e-caution correspondant au prix de remplacement du matériel sera prélevée sur le compte en banque du client. Lors du retour du matériel loué, un état des lieux complet de celui ci sera effectué. Si un endommagement (même involontaire) du matériel est constaté la caution sera conservé en attendant le règlement de la dégradation du matériel selon la grille tarifaire ci dessous : Lorsque le dédommagement sera réglé (par CB, chèque ou espèce), la e-caution sera rendue automatiquement. Si le client refuse de reconnaître ou payer le prix de l’endommagement du matériel loué, la e-caution sera encaissée.
ARTICLE 7
Modification or cancellation of the reservation. Modifications or cancellations are only possible by email to contact@vieuxboucau-surflodge.com, specifying the reservation number and the reason for the modification or cancellation. If the customer modifies their reservation and the rental fees are higher, the difference will be charged at the current rate. Villa Tiki retains the amount initially paid, and the additional amount will be collected upon delivery of the surf equipment. If the amount of the modified reservation is lower, this amount will be refunded upon delivery of the surf equipment.
ARTICLE 8
Use, responsibility, and return. Villa Tiki provides equipment in good working order and well-maintained. The client assumes full responsibility for the rented equipment from the moment they take possession of it. They remain responsible for it until its complete return.
In this respect, the client declares that they and any beneficiaries who may use the rented equipment are covered by civil liability insurance. The client acknowledges that surfing is a risky activity that can lead to accidents, injuries, or death.
The client knowingly accepts to bear the risks inherent in these activities.
The client also agrees to respect the rules inherent to the practice of surfing, available on the website of the French Surfing Federation: http://www.ecolefrancaisedesurf.fr/fr/decouvrir-le-surf/regles-pratique-surf. Therefore, the client releases Villa Tiki from all liability and agrees not to make any claim or take legal action against Villa Tiki in the event of injury, death, or accident involving themselves, their family, friends, or any third party.
By signing these general rental conditions, the customer acknowledges having read and understood this information.
Any reservations regarding the condition of the rented equipment must be noted on the rental agreement under the heading "condition report".
No claims will be accepted afterwards if this inventory does not mention any reservations.
In the event of a delay in returning the equipment on the scheduled date and time, the customer will remain solely responsible for the equipment in their possession until its actual return. The rented equipment must be returned at the end of the day of the period specified on the rental agreement.
Any delay in returning the equipment after this time will result in a charge of one day's rental per day of delay, at the rate displayed on the website. Failure to return the equipment may result in the initiation of a recovery procedure, the costs of which will be borne by the customer, in addition to the cost of the unreturned equipment being charged at its market value including VAT on the scheduled return date, rental fees, and any potential damages.
The customer remains responsible for any damage suffered by the rented equipment, with the exception of normal wear and tear or hidden defects.
He assumes responsibility for any other damage, which will then give rise to the payment of costs for repair or even replacement of said equipment, up to the maximum value of replacement in new condition at the public price thereof, in addition to the rental price.
The customer agrees to pay these fees upon return of the rented equipment.
Conditions générales de vente cours de yoga.
ARTICLE 1 : Conditions de réservation des cours de yoga
La réservation se fait par le site internet www.vieuxboucau-surflodge.com par carte bancaire. La totalité du paiement se fait à la réservation et sera débité en deux fois. Une première part de 30% du prix total sera débitée au moment de la réservation. La seconde partie de 70% sera débitée à la date de début de la réservation.

Carmen Urban ne peut donner de cours aux mineurs non accompagnés.
ARTICLE 2: Conditions for cancellation or modification by the customer
Chaque pratiquant se doit de confirmer sa participation à un cours 24h avant sa tenue. Carmen Urban se réserve le droit de modifier le planning de cours jusqu’à 6h avant le cours. Si vous êtes dans l’impossibilité de participer au cours à la suite d’une modification initié par Carmen Urban vous serez intégralement remboursé pour le dis cours
La modification ou annulation d’une réservation est uniquement possible par e-mail à l’adresse feelgoodyoga40@gmail.com en précisant le numéro de réservation ainsi que le motif de la modification ou l’annulation. Si le client modifie sa réservation et que les frais sont supérieurs, la différence lui sera facturée au tarif en vigueur. Carmen Urban conserve le montant initialement réglé et le montant supplémentaire sera demandé lors du premier cours pris. Si le montant de la réservation modifiée est inférieur, ce montant sera remboursé pendant votre séjour à la Villa Tiki.
Si vous arrivez en retard, ou ne prévenez pas de votre absence dans l’heure précédant le cours l’intégralité du cours sera due (hors cas de force majeure*).
ARTICLE 3 : Le Cours de Yoga
– Soyez présent 10 min avant l’heure de début de cours.
-Si vous arrivez en retard au cours sans prévenir en avance, Carmen Urban se réserve le droit de refuser votre participation au cours. Aucun remboursement ne sera possible, ell vous proposera de participer à un autre cours si possible.
– Entretien : les tapis et blocs devrons être nettoyés avec le spray mis à disposition après chaque cours.
ARTICLE 4: Responsibility
La dégradation volontaire du matériel de Yoga fera l’objet d’une facturation à la valeur de ré-achat.
La Villa Tiki Vieuxboucau Surflodge et Carmen Urban déclinent toute responsabilité en cas de vol, perte ou dommage de vos effets personnels pendant l’heure de cours.
Vous êtes tenus de pratiquer le yoga dans la bienveillance et le respect de votre corps, soyez attentifs et à l’écoute de vos ressentis. Vous demeurez responsable de votre pratique, de votre sécurité et de votre bien-être. La responsabilité de prendre une posture ou non, de la garder ou d’en sortir, vous revient.

ARTICLE 5: Force Majeure
Carmen Urban ne pourra être tenu responsable à l’égard du client en cas d’inexécution de ses obligations pour événement de force majeure. Sont considérés comme cas de force majeure ou cas fortuit ceux habituellement reconnus par la jurisprudence des Cours et Tribunaux Français.
ARTICLE 6: Computer Data
En application de l’article 27 de la Loi n° 78-17 du 6 janvier 1978, relative à l’informatique, vous disposez d’un droit d’accès et de rectification aux données vous concernant, en nous envoyant un courrier ou un e-mail.
